The first part of the afternoon study session is dedicated to the suspension of the award procedure, the revocation of the award, and the withdrawal from the contract. Under certain circumstances, the contracting authority is not obligated to award the contract, may initiate a new tender, or may entirely or partially forgo the execution of the services. When specific conditions are met, the contracting authority may or even must revoke the award. Accordingly, the provisions of public procurement regulations, further clarified by case law, that allow for the suspension or annulment of the procedure will be examined.
Subsequently, the post-award phase related to the conclusion of the contract will be explored. Once the award procedure is finalized, the contracting authority is required to proceed with the execution of the contract with the awarded bidder. The essential elements of the contract are generally determined by the content of the tender notice and the offer submitted by the awarded bidder. In this context, the discretion of the contracting authority in drafting the contract, as well as the limits imposed by law and case law, will be analyzed.
Last but not least, the final part of the session will focus on examining recent decisions by the Cantonal Administrative Court concerning both matters of general interest and recent developments in case law.
